Acceptable Use Policy
Mail Penguins Acceptable Use Policy
Effective date: October 4, 2026
Last updated: October 4, 2026
This Acceptable Use Policy explains the permitted and prohibited uses of Mail Penguins, a service operated by White Label Web Agency, based in Mariposa, California 95338.
This policy supplements our Terms of Service and applies to all clients and authorized users. You are responsible for ensuring that anyone using your account complies with it.
1. Permission-Based Email
Mail Penguins is intended for legitimate, permission-based email communications.
You must have valid permission to send marketing emails to your recipients and maintain records showing when, how, and for what purpose permission was obtained.
You must not use:
-
Purchased or rented mailing lists.
-
Addresses scraped from websites, directories, or social media.
-
Harvested, generated, or guessed email addresses.
-
Lists obtained without permission for your intended communications.
-
Another organization’s contact list without appropriate authorization and recipient permission.
A publicly available email address, previous transaction, or business relationship does not by itself establish permission under this policy to send marketing emails.
You must also comply with applicable privacy, advertising, and anti-spam laws.
2. Sender Identification and Message Accuracy
Your communications must accurately identify your business and the sender.
You must not use misleading sender names, forged headers, deceptive subject lines, or false claims about your identity or affiliation.
Include legally required contact information and a valid postal address where required. Clearly identify advertising where applicable law requires it.
Links and destination pages must accurately represent the products, services, or information being promoted.
3. Unsubscribe and Suppression Records
Marketing emails must provide a clear, working unsubscribe mechanism.
You must process unsubscribe requests within applicable legal deadlines and respect recipient preferences.
You must not:
-
Continue sending marketing emails after an applicable opt-out has been processed.
-
Remove or bypass unsubscribe links.
-
Require payment or unnecessary personal information to unsubscribe.
-
Re-add unsubscribed recipients without valid renewed permission.
-
Bypass suppression records by changing accounts, lists, domains, or sending providers.
Retain appropriate suppression records to prevent further unwanted marketing messages. Legally permitted essential service communications must not be used to disguise marketing.
4. Prohibited Content and Activities
You must not use Mail Penguins to create, send, promote, or facilitate:
-
Spam or unsolicited bulk email.
-
Phishing, impersonation, credential theft, or identity theft.
-
Fraudulent offers, scams, or materially deceptive advertising.
-
Malware, ransomware, malicious links, or harmful attachments.
-
Unlawful products, services, transactions, or activities.
-
Threats, harassment, or unlawful discrimination.
-
Content promoting violence, terrorism, or serious harm.
-
Child sexual exploitation or abuse.
-
Infringement of copyright, trademarks, privacy, or other rights.
-
Unauthorized disclosure or distribution of personal information.
You must not misrepresent results, endorsements, qualifications, or affiliations. You are responsible for ensuring that regulated products or services are advertised lawfully and comply with applicable delivery-provider restrictions.
5. Contact Data and Privacy
Only upload information you are authorized to collect, store, and use for the intended purpose.
Maintain accurate contact records and address valid correction, deletion, and privacy requests as required by law.
Do not upload passwords, payment card details, government identifiers, medical records, or other sensitive information unless we have expressly agreed to support that processing with appropriate safeguards.
You must not unlawfully sell, disclose, exchange, or distribute contact information through the service.
6. Account and System Security
Protect your account credentials and restrict access to authorized users.
You must not:
-
Attempt unauthorized access to accounts, systems, or data.
-
Probe or exploit security vulnerabilities without written authorization.
-
Interfere with service availability or delivery infrastructure.
-
Circumvent sending limits, account restrictions, or abuse controls.
-
Use additional accounts or domains to evade enforcement.
-
Share, expose, or misuse credentials or delivery-provider access keys.
Notify us promptly if you suspect compromised credentials, unauthorized sending, or a security incident.
7. List Quality and Sending Practices
Maintain current, relevant contact lists and use sending practices appropriate to recipient expectations.
You must address invalid addresses, repeated delivery failures, spam complaints, and signs of unwanted sending. Do not repeatedly send to addresses known to be invalid or suppressed.
We may restrict sending when campaign activity threatens service reliability, sender reputation, or delivery infrastructure.
Sending limits and provider thresholds may vary. Permission to use Mail Penguins does not guarantee that an infrastructure provider will approve a campaign or deliver it.
8. Third-Party Provider Requirements
Mail Penguins may use third-party infrastructure, including Amazon Simple Email Service.
You must comply with applicable provider policies and restrictions governing your use. Connecting your own provider account does not exempt you from this policy.
We may restrict activity where necessary to comply with a provider’s requirements or protect shared infrastructure.
9. Review and Cooperation
We may review relevant account activity, campaign content, delivery information, and compliance records where reasonably necessary to investigate abuse or protect the service.
We may request evidence of recipient permission, contact sources, sender identity, or steps taken to resolve complaints.
You must provide accurate information and cooperate reasonably. Failure to provide sufficient information may result in continued restrictions.
Reviews do not constitute legal approval of your campaigns or transfer your compliance responsibilities to us.
10. Enforcement
Depending on the circumstances, we may:
-
Request changes to a campaign or contact list.
-
Pause or reject a campaign.
-
Reduce sending allowances.
-
Restrict account features.
-
Suspend or terminate access.
-
Preserve relevant records where legally required.
-
Report suspected unlawful activity when required or otherwise legally permitted.
Where practicable, we will explain the concern and provide an opportunity to correct it. Immediate action may be necessary to protect recipients, clients, or infrastructure.
If you believe a restriction was applied incorrectly, contact us with supporting information. We will review the information and determine whether access can safely be restored.
11. Reporting Abuse
To report suspected abuse involving Mail Penguins, email privacy@mailpenguins.com.
Where possible, include the sender’s address, message date, subject line, and relevant message headers. Avoid including passwords or unnecessary sensitive information.
If the concern involves a specific sender’s mailing list, you may also contact that sender or use the message’s unsubscribe mechanism.
12. Changes to This Policy
We may update this policy and will publish the revised version with an updated date.
We will provide reasonable notice of material changes affecting existing users where practicable. Urgent legal, security, or provider requirements may require earlier action.
